The Behringer Harvard family of companies has created this privacy policy in order to demonstrate its commitment to your privacy. Our Web Site, www.behringerharvard.com (the “Web Site”), allows users to learn more about our products and services and those of our parent companies, subsidiaries, affiliates and affiliated funds. Also, our investors and their broker-dealers, financial advisors, IRA custodians, joint owners and other similar parties may use the Web Site to access their accounts with us. Use of the Web Site is subject to our Web Site Terms and Conditions and to our personal information gathering and dissemination practices and policies as described below.

Please note that third-party companies may operate and host the Web Site or portions of the Web Site on our behalf. If such companies do so, then they will collect the information described below on our behalf and disclose it to us.

Users Outside the United States
The Web Site is for users located exclusively in the United States of America. Please do not use the Web Site if you are located outside the United States, because the Web Site’s personal information practices and policies may or may not comply with applicable foreign laws.

BEHRINGER HARVARD CONSUMER INFORMATION PRIVACY POLICY

Introduction
The Behringer Harvard family of companies (“we” or “Behringer Harvard”) takes measures to ensure that our use and disclosure of your non-public personal information is consistent with applicable law.

This Consumer Information Privacy Policy (“Privacy Policy”) explains the categories of information we collect and disclose; how and why, in certain cases, we share such information with Behringer Harvard companies or with other parties; and how we protect your information. Our current Privacy Policy is effective December 1, 2008, and may be amended from time to time.

Our Privacy Policy applies to non-public personal information we collect or use to provide investment products or services to individuals for primarily personal, family, or household purposes. Our Privacy Policy also applies to non-public personal information we have collected concerning former Behringer Harvard investors.

If you own Behringer Harvard investment products, or receive Behringer Harvard services, in the name of a third-party broker-dealer, investment advisor, or other financial service provider, that third party’s privacy policies may apply to you.

Information We Collect and May Disclose
We collect, use, and share information about you to conduct our business, to make you aware of our products and services, to provide you with our products and services, and to comply with legal and regulatory requirements.

We may use and disclose several categories of non-public personal information about you that we collect from the following sources:

  • Information we receive from you through applications, subscription agreements, or other means, such as name, address, e-mail address, social security number, age, marital status, tax identification number, account information, number of dependents, assets and debts, income and net worth, employment history, beneficiary information, or personal bank account information

How We Use and Disclose Information
The Behringer Harvard network of affiliated companies, sponsored investment programs, and third-party service providers work together to maintain an efficient and effective network of products and services. By sharing your information with our companies and service providers, we are better able to serve your investment needs and also suggest services, products, or educational materials that may be of interest to you. We may use or disclose the non-public personal information we collect as follows:

  • Internal Use. We may use your non-public personal information internally for the purposes of furthering our business, which may include analyzing your information, matching your information with the information of others, processing transactions and services, maintaining accounts, resolving disputes, preventing fraud, and verifying your identity.
  • Aggregate Use and Disclosure. We may use and disclose your non-public personal information on an aggregate basis. This means that we combine parts of your information with parts of the information from our other users without including your name, complete telephone number, complete e-mail address or your street address in the combination. Examples of how we use aggregate information include determining the most common ZIP code among the users of the Web site and disclosing that ZIP code to other parties, or determining and disclosing demographic information such as the average income of investors in our investment programs.
  • Other Uses and Disclosures. We may use and disclose your non-public personal information in order to:
    • Correct technical problems or malfunctions in how we provide our products and services to you and to process your information
    • Protect the security and integrity of our Web site and our Internet service, or to enforce our Terms and Conditions with you
    • Protect our rights and property and the rights of property of others

Parties to Whom We Disclose Information
We may disclose non-public personal information about you to the following types of third parties:

  • Financial service providers, such as for customer-initiated service requests, establishing and managing your investor accounts, completing your investor transactions, or pursuant to joint marketing agreements
  • Non-financial companies, such as those marketing our own investment products and services, serving as our transfer agents, handling check printing, or providing data storage or processing
  • Others, such as broker-dealers, financial advisors, joint owners, IRA and other ERISA custodians, or other parties acting on your behalf

We may share your non-public personal information with Behringer Harvard affiliates or with non-affiliated service providers who perform business functions on our behalf. But before we disclose non-public personal information to non-affiliated parties, we contractually require them to keep our investor non-public personal information confidential and secure, and to use it only as authorized by us.

We may also disclose your non-public personal information to companies that perform marketing services on our behalf or to other financial institutions with which we have joint marketing agreements. Behringer Harvard does not disclose, sell, or rent your information to outside marketers who may want to offer you their own products and services. We require all joint marketers to have written contracts with us that specify appropriate use of your personal information, require them to take steps to safeguard your personal information, and prohibit them from making unauthorized or unlawful use of your personal information.

We will share your non-public personal information with non-affiliated third parties only as permitted by law and as described above. Should our disclosure policy change in the future, we will provide you with notice regarding the option to “opt-out” of such disclosures.

How We Protect Your Information
We maintain physical, electronic, and procedural safeguards designed to protect the confidentiality and security of your non-public personal information. We also restrict access to non-public personal information to those employees who have a legitimate business need for the information.

Availability of Our Privacy Policy
We will provide notice of our Privacy Policy annually, as long as we continue to provide you with financial products or services that are used primarily for personal, family, or household purposes. Notification of Changes to Our Privacy Policy
If we decide to change our Privacy Policy, we will post those changes on the Web site. If at any point we decide to use or disclose your non-public personal information in a manner different from that stated at the time it was collected, we will notify you in writing. We will otherwise use and disclose non-public personal information in accordance with the Privacy Policy that was in effect when such information was collected.
